Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website located at vabasso.com and any related services, features and communications provided by Vabasso Corporation (“Vabasso,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms.

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to interfere with the operation of the Services, attempt to gain unauthorized access to any portion of the Services, or use the Services in any manner that could damage, disable, overburden or impair them.

All content on the Services, including text, graphics, logos, icons, images, video and software, and the design and arrangement of that content, is the property of Vabasso or its licensors and is protected by intellectual property laws. You may not reproduce, modify, distribute or otherwise exploit any content without our prior written permission.

“VABASSO” and the Vabasso logo are trademarks of Vabasso Corporation. Nothing in these Terms grants you any right to use our trademarks without our prior written consent.

Information on the Services is provided for general informational purposes only and does not constitute financial, tax, legal, investment or lending advice.

Vabasso.com is a corporate information site. It does not accept mortgage applications, does not evaluate credit, and does not make lending decisions. Nothing on the Services constitutes an application for credit, a commitment to lend, an offer of credit, or a promise of a specific rate or term.

Mortgage lending services are offered through Vabasso Mortgage, NMLS #2864025, at mortgage.vabasso.com, and are governed by that property’s own terms, disclosures and eligibility requirements. Loan approval is subject to underwriting, program guidelines and applicable law. Vabasso Mortgage originates only in states where it holds all required licenses and approvals.

This section supersedes the corresponding clause in the prior published Terms, which stated that Vabasso is not a mortgage lender. That statement predates the launch of Vabasso Mortgage and is no longer accurate. The revised wording is pending legal review.

The Services describe Vabasso products but do not deliver them. Each product is reached at its own destination and is governed by its own terms:

• Vabasso Mortgage — mortgage applications, licensed advice and lending disclosures at mortgage.vabasso.com.
• Vabasso Market Intelligence — rate benchmarks, housing data and economic context at markets.vabasso.com. Market Intelligence content is informational market commentary. It is not a rate quote, a forecast you should rely on, or advice about your individual circumstances.

Where these Terms and a product’s own terms both apply, the product’s terms control for that product.

Vabasso is actively developing an intelligent homeownership ecosystem. Product names, features, launch timing and availability may change at any time and without notice. Statements about future functionality reflect current expectations only and are not binding commitments. Any future product or service will be subject to its own terms, disclosures, eligibility requirements and applicable law.

• Provide accurate and complete information in any correspondence you send us.
• Do not use the Services to transmit unlawful, harmful or infringing content.
• Do not attempt to reverse engineer, scrape or extract data from the Services except as expressly permitted.
• Comply with all applicable laws and regulations in connection with your use of the Services.

The Services may contain links to third-party websites, resources or services that are not owned or controlled by Vabasso. We do not endorse and are not responsible for the content, policies or practices of any third-party sites or services. Your use of any third-party site is at your own risk.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. Vabasso does not warrant that the Services will be uninterrupted, secure or error-free, or that content will be accurate or complete.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VABASSO AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100).

You agree to defend, indemnify and hold harmless Vabasso and its affiliates from and against any claims, damages, liabilities and expenses (including reasonable attorneys’ fees) arising from your use of the Services or your violation of these Terms.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising from or related to these Terms or the Services will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when they were most recently revised. Continued use of the Services after any change constitutes acceptance of the updated Terms.
